Clerk makes deal to give up notary license

    Longtime Rotterdam Clerk Eunice Esposito will be required to surrender her notary license for six months, according to a settlement agreement detailed by state officials Tuesday.
    Joel Barkin, a spokesman from the New York Department of State, said Esposito also will need to either take a three-hour course or pass a state exam before her powers as a notary are restored. He said the agreement was reached last week, meaning that Esposito will not need to present her case at a hearing.
    “This was the agreed-upon penalty,” he said.
    Andrew Brick, Esposito’s attorney in the matter, said he couldn’t confirm or deny the settlement. Likewise, Esposito said she wouldn’t discuss the matter.
    “I haven’t heard anything on it, so I’d rather not comment,” she said.
    Last month, Esposito admitted to notarizing documents without having people sign them in front of her, as required by law. She said she had no intent to defraud the town but performed the duty as a courtesy to senior citizens seeking exemptions provided by the School Tax Relief (STAR) program.
    “I know it is their signature. It is not the first time,” she told the Gazette in February. “There is no fraud, no intention to circumvent the law. Agreed, Peeper - everyone committing fraud should be punished accordingly. It has been proven that Eunice has.  Lodge a formal complaint with the appropriate authorities against Surprise, and I think myself and MT will be the first to support it!

On this rare occasion, I gotta agree with you. Show me something legally that Mr Surprise has done wrong, show me a proven FACT or admission of guilt ... then I'll push for his removal or discipline as I endorsed EE's.

So far, it's all accusations & allegations. Yes, people may not like him - they're not happy with their assessments ... but show me, fact, what he's done wrong. Else put an end to this.

Even their own Ethics board has nothing yet on Mr Surprise ... that's pretty telling right there.

Does this worry anyone else?  What is happening here?  Is Eunice totally oblivious to what's going on around her?  Or is the former town attorney, transition team attorney, Sync Realty attorney (suing the town) and Eunice's attorney acting without her knowledge or consent?

Either way, this definitely doesn't pass the smell test!

Not senility? In all do respect.....there has been error after error with others residents, due to senility, who won't come forward 'cause they think she is a nice person'.

I don't think anyone is saying that she is not a 'nice person'....cause she is. People are just questioning her 'ability' to do the job efficiently.

If there was "good sense" as you say, she wouldn't have notarized any documents without the person
being present on several occasions. Anyone who cannot see that she is suffering from senility is delusional.

MM I think you might have a touch of senility yourself.  You keep repeating yourself and what you say never makes sense.  You do not seem to even understand my post.  It was "good sense" for Eunice to NOT respond to the comment.  Since you are rarely cogent in your comments, I wouldn't be picking on Eunice.
